Fort Myers Trust Administration Lawyer

Advising Florida Trustees and Litigating Trust Disputes

If you have been named as the trustee of an estate planning trust created by a loved one who has died, you may have questions about what it means to be a trustee and what you have to do to fulfill your lawful responsibilities. An experienced lawyer can guide you through this process.

At Kuhn Law Firm, P.A., we assist trustees with the administration of trusts, and we represent both trustees and other parties in trust disputes. Fort Myers trust administration lawyer Scott A. Kuhn provides individualized guidance and representation in every case our firm accepts.

Understanding the Role of Trusts in Estate Administration

A trust is an entity in which assets are put under the control of a trustee to be used for the benefit of one or more beneficiaries. Trusts play an important role in many people’s estate plans. The following are two of the most common types of estate planning trusts:

  • Revocable trusts: A revocable trust (aka living trust) is a trust that is largely controlled by the person who created it during his or her life. That person is normally the trustee until his or her death, at which point a successor trustee is appointed to take charge of the trust.
  • Contingent trusts: A contingent trust is a trust that is created by the will of someone who directed his or her assets into the trust only after his or her death. Contingent trusts are most often used to provide for the care of children who are minors or young adults.

Very often, the person who is named as the trustee of an estate planning trust is also named as the executor of the deceased person’s will. Scott Kuhn can guide you through the trust administration process alongside, or separately from, the estate administration process.

Our firm can also represent you in any trust disputes that may arise, including trust contests and breach of fiduciary duty claims. We represent trustees and other parties in these matters.
