A properly executed will is normally treated as evidence of a deceased person’s wishes regarding how his or her assets will be distributed. However, there are a number of circumstances in which a probate court can invalidate a will, including the following:

  • Undue influence: The will was drafted or revised under the direction of someone who had excessive financial or personal influence, and that person would benefit from the will.
  • Fraud: The will was drafted or revised on the basis of a misrepresentation or other deception by someone who had something to gain from the new provisions of the will.
  • Incapacity: The subject of the will did not have the physical or mental capacity to make a legally valid will at the time the most recent version of the will was drafted or revised.
